Abstract：This paper investigates the impact of Non-Practising-Entities on investment in a model where firm competition and the licensing of intellectual property are considered in detail. Although the model is simple, characterizing equilibrium behavior turns out to be complex with a variety of different outcomes, depending on the specifics of profit functions, innovation distributions and so forth. As a result, it is difficult to make blanket statements to the effect that NPE's either increase or inhibit investment in this environment. Nevertheless, some general conclusions may be drawn depending on a comparison of two threshold parameters, such that in one case, the NPE presence is likely to increase overall investment; and in the other, likely to reduce overall investment.
